Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Proxyify platform at proxyify.dev, a product of TS Technology. By creating an account or using the API, you agree to these Terms. If you do not agree, do not use the platform.

1. Description of Service

Proxyify is an AI gateway that provides access to third-party AI models via a single API endpoint. We act as an intermediary between you and model providers via our AI routing infrastructure. We do not operate the underlying AI models.

2. Accounts

• You must be at least 13 years old to use Proxyify.
• You are responsible for maintaining the confidentiality of your API keys and account credentials.
• You are responsible for all activity that occurs under your account and API keys.
• You must promptly notify us at hello@proxyify.dev if you suspect unauthorized access.

3. Credits and Billing

• Access to AI models requires credits purchased through the platform.
• Credits are non-refundable once consumed by API requests.
• Unused credits do not expire.
• Credit prices reflect a markup over underlying model costs to cover platform operation.
• We reserve the right to adjust pricing with at least 14 days notice for existing users.
• Payments are processed by LemonSqueezy. By purchasing credits you also agree to LemonSqueezy's terms.

4. Refund Policy

Credits that have not been consumed by API requests may be eligible for a refund within 14 days of purchase. To request a refund, contact hello@proxyify.dev with your order details. Refunds are issued at our discretion and will not be granted for credits partially or fully consumed.

5. Acceptable Use

You agree not to use Proxyify to:

• Generate, distribute or store illegal content including but not limited to CSAM.
• Facilitate harassment, threats, or abuse of any person or group.
• Send unsolicited communications (spam) or conduct phishing attacks.
• Circumvent or attempt to circumvent rate limits, security controls or access restrictions.
• Reverse engineer, decompile or attempt to extract the source code of the platform.
• Resell API access without our prior written consent.
• Violate the acceptable use policies of the underlying model providers.

We reserve the right to suspend or terminate accounts found in violation of these policies without notice.

6. Rate Limits

Free plan accounts are subject to platform-level rate limits (20 requests per minute, 200 requests per day). Paid plan accounts are not subject to Proxyify-level rate limits; throughput is only constrained by upstream model provider capacity.

7. API Keys

API keys you create are your responsibility. Configuring restrictions (IP allowlist, origin allowlist, spending limits) is strongly recommended. We are not liable for unauthorized use of your API keys that occurs before you notify us of a compromise.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Downtime may occur due to maintenance, upstream provider outages or events beyond our control. We are not liable for losses resulting from service unavailability.

9. Intellectual Property

The Proxyify platform, its design, code and documentation are owned By Proxyify and protected by copyright. You may not copy, modify or distribute any part of the platform without written permission.

10. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. AI model outputs may be inaccurate - you are responsible for validating outputs before acting on them.

11. Limitation of Liability

To the maximum extent permitted by law, Proxyify shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits or data, arising from your use of the platform. Our total liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time from the dashboard; unused credits are forfeited upon deletion.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated by updating the "Last updated" date. Continued use after the effective date constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Proxyify is incorporated, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration before resorting to litigation.
